Serving clients who are experiencing diminished or complete incapacity presents unique challenges for attorneys, estate planners, and financial professionals. This program explores the ethical responsibilities and real-world considerations that arise when capacity is in question. Attendees will gain insight into recognizing warning signs of diminished capacity, balancing client autonomy with fiduciary duty, navigating confidentiality and decision-making authority, and coordinating effectively with family members, caregivers, and other professionals. Through case examples and best practices, participants will learn strategies to protect vulnerable clients while upholding ethical standards and legal obligations.
