This presentation will cover a range of issues and considerations, both ethical and strategic, in helping clients head off potentially costly (and otherwise damaging) post-death litigation over their estates. Topics covered will include: Ethical considerations for estate planners and advisors; screening and evaluating clients for diminished capacity, undue influence, and related concerns; tips and traps for handling the representation of a potentially vulnerable client; and effective post-death tools and strategies for avoiding litigation.
